01Acceptance of the terms

By browsing this site, submitting a form or communicating with us through it, you acknowledge that you have read, understood and accepted these terms, as well as our privacy policy. These terms may be updated from time to time, as set out in section 10.

02The site and its content

This site is informational in nature. It presents the estate, its activities, the Cercle du Manoir Blackswan, and the possibilities for weddings, stays and events. The content is provided for guidance and may be modified at any time, without notice. The images, texts and descriptions do not constitute a contractual offer.

03Intellectual property

All content on the site, including texts, photographs, graphic elements, the name "Manoir Blackswan", the logo and the visual identity, is protected and remains the property of Manoir Blackswan Inc. or its licensors. Any reproduction, distribution, modification or use, in whole or in part, without our prior written authorization, is prohibited.

04Permitted use

You agree to use the site in a lawful and respectful manner. It is prohibited, among other things, to:

• Use the site for illegal, fraudulent or unauthorized purposes
• Attempt to gain unauthorized access to our systems, accounts or data
• Interfere with the operation of the site or compromise its security
• Collect information about other users without their consent
• Reproduce or exploit the site's content for commercial purposes without authorization

05Applications, memberships and bookings

Submitting an application to the Cercle, an information request or a booking request through the site does not constitute a membership, a reservation or a commitment on our part. Admission to the Cercle remains at the discretion of the Conseil du Domaine and is never guaranteed.

Every membership, wedding, stay and event is governed by a separate agreement setting out the applicable terms, rates and conditions. In the event of a discrepancy, that separate agreement prevails over the content of the site. The rates, packages and availability presented or mentioned on the site are indicative and may change without notice.

06Information provided by the user

You are responsible for the accuracy of the information you send us through the site. You agree to provide truthful and up-to-date information, and not to submit any content that would infringe the rights of a third party.

07Links to third-party sites

The site may contain links to sites operated by third parties, including our member area and our service providers. These sites are independent and governed by their own terms. We are not responsible for their content or their practices.

08Availability and absence of warranty

We strive to keep the site accessible and up to date, but we do not guarantee that it will be free of errors or interruptions. The site and its content are provided "as is". To the extent permitted by law, we exclude any warranty, express or implied, as to the accuracy, reliability or availability of the site.

09Limitation of liability

To the extent permitted by law, Manoir Blackswan Inc. cannot be held liable for direct or indirect damages arising from the use of, or inability to use, the site, or from reliance placed on its content. Nothing in these terms excludes any liability that cannot be excluded under the law.

10Changes to the terms

We may amend these terms at any time. The version in force is the one published on this page, with its update date. By continuing to use the site after a change, you accept the revised terms.

11Governing law and jurisdiction

These terms are governed by the laws in force in the Province of Quebec and the laws of Canada applicable therein. Any dispute relating to the site or to these terms falls under the exclusive jurisdiction of the courts of the Province of Quebec.

12Language

The parties have required that these terms be drawn up in French. This English version is provided for convenience. In the event of a discrepancy, the French version prevails.
